Terms of Service

1. Acceptance of Terms
By accessing or using Seer ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
2. Service Description
Seer provides real-time emotional intelligence and behavioral analytics for websites:
- Behavioral telemetry collection and analysis
- Emotional state detection using AI/ML models
- Real-time intervention deployment
- Analytics dashboard and reporting
- API access and webhook integrations (on eligible plans)
3. Account Registration
To use the Service, you must:
- Create an account with accurate information
- Maintain the security of your account credentials
- Notify us immediately of unauthorized access
- Be at least 18 years old or have legal authority
You are responsible for all activities under your account.
4. Acceptable Use
You agree NOT to:
- Use the Service to collect or store PII without proper consent
- Attempt to reverse engineer, decompile, or hack the Service
- Use the Service for illegal, fraudulent, or malicious purposes
- Overload or interfere with the Service infrastructure
- Resell or redistribute the Service without authorization
- Scrape or extract data using automated means
- Deploy on websites you don't own or operate
5. Data Ownership
Your Data: You retain all rights to data collected from your website visitors. We process this data on your behalf.
Our Data: We retain ownership of all ML models, algorithms, aggregated insights, and platform code.
We may use anonymized, aggregated data to improve the Service. We never share customer-specific data.
6. Privacy and Compliance
You are responsible for:
- Complying with applicable privacy laws (GDPR, CCPA, etc.)
- Posting appropriate privacy policies on your website
- Obtaining necessary consents for data collection
- Implementing opt-out mechanisms if legally required
Seer's behavioral analytics collect zero PII by design. Contact data (name, email, phone) is collected only when voluntarily submitted by your visitors. You are responsible for your own compliance, including maintaining an accurate privacy policy on your website. Our Data Processing Agreement governs how we process this data on your behalf.
7. Service Availability
- Standard plans: Best-effort uptime, no SLA
- Enterprise: 99.97% uptime SLA with credits for downtime
8. Termination
Either party may terminate this agreement:
- You: Cancel your subscription at any time
- Us: Suspend or terminate for Terms violations, non-payment, or illegal activity
Upon termination, access will cease and data will be deleted per our retention policy.
9. Warranties and Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
We do not warrant that the Service will be error-free, secure, or uninterrupted. Emotional intelligence predictions are probabilistic and not guaranteed to be accurate.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Total liability: amount paid in 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Seer from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or dashboard notification. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of Delaware, United States. Any disputes shall be resolved in the courts of Delaware.
